On March 27th 2019, the Chamber of Deputies of the Grand-Duchy of Luxembourg adopted the draft law amending (1) articles L.232-2 and L.233-4 of the Labour Code and (2) article 28-1 of the amended law of April 16th 1979 establishing the general status of civil servants (hereinafter the “Law”).
The purpose of the Law is to implement two elements of the 2018-2023 Coalition Agreement, which provide in particular that:
- the minimum statutory paid leave will be increased from the current 25 days to 26 days per year and
- May 9th will be declared a public holiday in Luxembourg.
Additional day of paid leave
The Law provides that the minimum statutory paid leave will be increased from the current 25 days to 26 days per year, regardless of the employee's age. This measure concerns:
- all employees;
- all persons working to acquire vocational training.
Additional public holiday
May 9th will be declared a public holiday in Luxembourg. The Law therefore provides that the following public holidays will be statutory holidays:
- New Year's Day
- Easter Monday
- May 1st
- Europe Day (May 9th)
- Ascension Day
- Whit Monday
- the day of the public celebration of the Grand Duke's birthday on June 23rd
- the Assumption
- All Saints' Day
- the first and second Christmas days.
The Law will enter into force on January 1st 2019.
According to the legislative procedure, the Law must still be submitted to a second constitutional vote before being published in the Memorial.
